Anyone written a SaaS sales agreement prior to a startup incorporation?


We went from idea to launch to now first signing within a couple of weeks. While we’re not reluctant to incorporating our startup, I wonder if there’s a low (no)-effort way to state within the sales agreement that the company name is tbd, and will comprise of us 2 individuals (me and my cofounder).

That way we can continue our efforts on building and sales, and collect payment later. We're using this sales agreement posted by YC as our template: https://www.ycombinator.com/sales_agreement

We also don't believe that not having a company is the make or break in this contract. But can't be sure.

Talk to the prospective customer. Be honest. Find out what will meet their needs and do that.

Because relationships are the most important thing.

Keep in mind that your urgency of signing a first contract is not your customer's urgency to sign another contract. Don't bet big on landing them. Don't stop selling because they sound positive. Figure January if you are very lucky.
