Why doesn't DALL·E 2 give you probability of being sued for each image?

If the art created by the AI is quite similar to one of its training images, then this probability would be high.So you would avoid using such an image in a commercial project.

AI's cannot create nor have legal ownership of an image. Therefore, the user of the software takes responsibility that his or her publication doesn't infringe.All of the images created by DALL-E are not only similar, they are derivative and contain portions of the images in the learned dataset. Like any clip art provider, one hopes that DALL-E is sourced with images that are royalty-free.

Could you explain "quite similar" and how would you compute a probability? Seems like a fake concern
