Does this mean Docker is not open-source software?

If Docker soon requires a paid subscription for companies of a certain size, doesn't discriminate against a use case...or user (?)...so would that make it not free or OSS?

Your link seems pretty specific that the subscription stuff is for Docker Desktop; I don't use Docker, but this seems to be a different product?
